  • Client / You: The person or entity requesting or receiving services or using the Website.
  • Services: Any physical work, installation, repair, maintenance, assessment, or advising provided by COYCO (electrical, air conditioning, solar, heating, or related works).

2.1 Scope & Acceptance

These Terms apply to all website users and clients engaging COYCO. A client is deemed to accept these Terms by:

  • Requesting or accepting a quote.
  • Booking or requesting work.
  • Accessing or using the Website beyond simple browsing.

Where a separate written contract, quote, or service agreement is executed, the specific terms of that document will apply, together with these Terms unless expressly superseded.

2.2 Governing Law

These Terms are governed by and construed in accordance with the prevailing law of Western Australia, Australia. Both parties submit to the non-exclusive jurisdiction of WA courts.

3.1 Website Accuracy & Availability

We aim to keep Website content accurate, but do not guarantee completeness or that the Website will be uninterrupted or error-free. COYCO may modify or remove content without notice.

4.1 Ownership

4.2 Limited Client Licence

You are granted a limited licence to view and download content for personal, non-commercial use only. You must not reproduce, republish, sell, sub-license, adapt, distribute, or otherwise exploit Website content without prior written permission from COYCO.

4.3 Deliverables

Any documentation prepared by COYCO for the purposes of quoting and performing services (designs, reports) remains COYCO’s intellectual property until final payment is made in full.

5. Client Services — Quotes, Fees & Payment

5.1 Quotes & Variations

  • Fixed Price Promise: Unless stated otherwise, an accepted written quote becomes the contract price. We do not provide “ballpark” estimates.
  • Variations: If unforeseen site conditions (e.g., concealed defects, asbestos) or additional works are required, we will promptly advise you and will not proceed until you accept a revised quote in writing.
  • Call-Out Fees: A call-out fee may apply for emergency, fault-finding, or after-hours service. This will be clearly disclosed to the Client prior to confirmation of the booking.
  • Free Quotes: We offer free, upfront quotes for new installations and replacement services; however, standard call-out fees apply for troubleshooting, repairs, or fault-finding appointments.

5.2 Payment Terms

  • Deposits: A deposit may be required (as stated on the quote) to secure materials and booking dates.
  • Invoicing: Final payment is due on completion unless otherwise agreed in writing.
  • Methods: We accept EFT, credit/debit card, or other methods specified on the invoice.
  • Late Payment: Overdue amounts may attract interest and recovery costs as permitted by law.

5.3 Title Retention

Ownership of all supplied Goods (e.g., solar panels, air conditioning units, heaters) remains with COYCO until full payment is received.

6. Service Compliance, Warranties & Liability

6.1 Compliance

All Services are carried out by appropriately licensed electricians and are in accordance with applicable Australian Standards (AS/NZS 3000) and WA licensing/regulatory requirements. Certificates of Compliance will be provided where legally required.

6.2 Warranties & Guarantees

  • Workmanship Warranty: COYCO warrants that workmanship will comply with applicable standards. Specific warranty periods will be provided in your written contract.
  • Manufacturer Warranty: Product warranties (e.g., on solar, HVAC, Jarrahdale heaters) are provided by the respective manufacturers (e.g., Fujitsu, Daikin, GoodWe, Fronius, Jinko). We will assist with claims for faults caused by installation where applicable.
  • Exclusions: Warranties do not cover damage from misuse, negligence, unauthorised modification, lack of maintenance, or events beyond COYCO’s control.

6.3 Limitation of Liability

To the full extent permitted by law, COYCO’s liability for breach is limited to re-supply of services or payment of the cost of re-supply. COYCO is not liable for indirect, incidental, or consequential loss (including loss of profits), except where law prohibits such exclusion.

6.4 Consumer Rights

Nothing in these Terms limits your statutory rights under the Australian Consumer Law (ACL), including guarantees as to acceptable quality, fitness for purpose, and due care and skill.

7. Client Obligations, Safety & Access

7.1 Site Access & Safety

You must provide safe and unobstructed access to all work areas (switchboards, roof spaces, etc.). You are responsible for removing hazards and securing pets. COYCO may postpone or stop work if conditions are deemed unsafe.

7.2 Safety Instructions

You agree to follow COYCO’s safety instructions after work is completed (e.g., operation and maintenance requirements).

7.3 Cancellations & Refunds

If you cancel or reschedule a booking, reasonable notice is required. If materials have been ordered specifically for your job, a restocking/cancellation fee may apply. Refunds are handled consistent with Australian Consumer Law.

8. Dispute Resolution & Amendments

8.1 Dispute Resolution

If a dispute arises, we encourage prompt contact to resolve matters amicably before pursuing external legal action.

8.2 Changes to Terms

COYCO may update these Terms from time to time. The effective date at the top indicates the current version. Continued use of the Website or COYCO services after changes constitutes acceptance.

8.3 General Provisions

If any provision is unenforceable, the remainder of these Terms remain in force. Headings are for convenience only and do not affect interpretation.
